terms & conditions

By continuing to access the SISU studio or website you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with the privacy policy, govern SISU’s relationship with you in relation to the website and studio. The term ‘you’ refers to the user or viewer of our website/studio. We reserve the right to update, change or replace any part of these Terms and Conditions at any time. It is your responsibility to periodically check our website for changes. If you disagree with any part of these terms and conditions, please do not use this website.

STUDIO TERMS & CONDITIONS

Please read through the Terms and Conditions on our website thoroughly before enrolling for a class. When registering as a client at SISU, you agree to the terms and conditions as laid out on our website, www.sisustudio.co.nz

  • Our studio is an inclusive space. We will not tolerate any kind of discrimination or behaviour that creates a hostile and unpleasant environment for staff or members. 

  • We endeavour to deliver all our classes on time and as advertised, however classes are subject to change or be cancelled without notice. SISU is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.

  • Out of consideration for the teacher and other clients we ask that you arrive at least 3 minutes before the start time of the class. For security reasons the door to the studio is locked at the beginning of each class. If you are late, you may not be let in so as not to disrupt the class.

  • If a class you would like to attend is fully booked please sign up for the waiting list. Should a place become available then you will be added automatically before the scheduled class.

  • A minimum of two people is required for a class to go ahead. You will be contacted via text or email should a class be cancelled and your session will be credited back to your account.

  • Cancellations/rescheduling classes need to be made more than 12 hours prior when to your class begins. Late cancellations will incur a lost session for all Intro Offers/Class Passes/Private sessions.

  • Sessions are not transferrable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own sessions.

  • Bookings are to be made via the SISU website via the schedule displayed or via the Momence app. We do not accept bookings or payments over the phone, email or in studio.

  • To book into a class you must either have credit in your account or pay at the time of booking. Classes are on a first come first serve basis and can be booked up to 30 days in advance.

  • SISU is not responsible for the safekeeping of your belongings when attending a class in studio.

  • SISU has the right to refuse entry at anytime. Our instructors reserve the right to direct clients to a particular class type for safety reasons; instructors also reserve the right to turn clients away for any reason they deem necessary (for example, failing to follow the instructions given).

  • Clients must follow the instructions given around how to use, operate and exercise on the Reformer and/or any other equipment that is used both in (and out if applicable) the studio. Failing to do so may result in you being asked to leave the studio and forfeiting your pass.

  • Classes at SISU may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. You agree to follow all instructions given to you by SISU instructors and you acknowledge that any failure to do so will be at your own risk. SISU is in no way liable for any injury, loss of property or death resulting from attending our studio.

  • Because we rely heavily on social media for advertising, there may be times when the class is filmed or pictures are taken to be put onto social media. If you prefer not to be shown in our videos and pictures on social media, it is your responsibility to tell the instructor at the start of class. We have no control over clients posting content that shows other clients in the studio; we may reshare this content on our social platforms.

  • By booking into and participating in a class* you automatically agree to these terms & conditions.

  • *This includes live or recorded online classes as well as those in our Content Library

CANCELLATION POLICY

  • Class cancellations are the responsibility of the person booking the class and can be made via the Momence app. Cancellations via phone, email or social media will not be accepted.

  • Class cancellations can be made up to 12 hours prior to your class start time without penalty.

  • Clients using Intro Offers/Memberships/Class Passes/Private Session Passes who pre-book a class but cancel the booking less than 12 hours prior to the class start time will forfeit their class and the credit will not be returned to your account for this missed class.

  • In exceptional circumstances we will waive our cancellation policy. Exceptional circumstances include self or direct family in hospital, death in direct family and natural disasters. Direct family refers to parents, siblings, spouse and children. In any circumstance other than these, the cancellation will not be waived.

  • Fluctuations in traffic/day-to-day work/school/social/family schedules do not constitute and are not considered exceptional circumstances.

NO SHOWS

  • Clients using Intro Offers/Memberships/Class Passes/Private Session Passes who pre-book a class but fail to attend will forfeit their class and the credit will not be returned to your account for this missed class.

PRICING & REFUNDS

  • All prices are quoted in New Zealand Dollars ($NZD) and all transactions are processed in New Zealand Dollars ($NZD). Prices, products and offers include GST.

  • All prices are correct at the time of online publication. Prices are subject to change without notice.

  • Sale items are only available at the lower price during the sale period.

  • Unforeseen supply problems or unexpected demand may occasionally result in stock being unavailable.

  • We reserve the right to amend prices and printing errors.

  • Prices may increase from time to time to reflect increases in cost and benefits. To keep you healthy, we must keep our business healthy.

  • All purchases are final. SISU does not offer refunds, transfers, suspensions or extensions on services, workshops or products for change of mind, change of address or any other reason. We will consider extensions on class packs upon sudden injury, illness with a medical certificate and pandemic-related lockdowns.

  • All passes and memberships are non-transferable between clients.

  • SISU reserves the right to bill the client the cost of any additional bank fees which may incur from disputed or failed transactions regarding a clients account.

  • All payments are processed through Stripe, which is a third party online payment system. SISU has nothing to do with any additional fees that may be charged as a result of card fees or clients having insufficient funds during payments. Refunds through Stripe may take 7-10 working days and will go back onto the card that was used for the original purchase.

  • Refunds will not be given unless goods/services are not provided and an extension on validity of Passes is not an option. In the case of workshop tickets and passes, these are non-refundable and make up classes will not be given if a session is missed; by signing up to a workshop it is assumed clients will attend all sessions included in the workshop.

GIFT CARDS

  • Gift Cards can be used for classes or merchandise at SISU.

  • Gift Cards are not redeemable for cash and are not transferable.

  • SISU does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason. All purchases are final.

  • We accept no responsibility if a gift card is lost, stolen, destroyed, or used without your permission.

  • Gift Cards may be purchased by emailing hello@sisustudio.co.nz with Class Passes, Private Sessions or a dollar amounts able to be purchased (Intro Offers are NOT included). Our Gift Cards have a 6 month expiry date from date of purchase. No change will be given for money left over on Gift Cards.

CLASS PASSES

  • 5, 10 and 20 Class Passes are valid for twelve months from the date of the first class booked.

  • Pass extensions are only available upon sudden illness or injury, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Session packs are non-transferable and non-refundable.

  • Passes cannot be shared. Anyone found to be sharing their pass will be denied entry and have their pass cancelled.

  • Any non-cancellations, no show or absence will result in forfeiting that visit. If you do not attend a booked session or cancel within 12 hours of the class start time, you will be charged for the class.

  • SISU has the right to terminate a pass without notice for any unsatisfactory behaviour or other reasons decided by us, which occurs on our premises, in writing, or is directed at our staff or other members.

INTRO OFFERS

  • Intro Offers are available only once per person and cannot be shared, suspended or refunded for any reason.

  • The activation date is the date of the first class booked.

  • Our New Client Intro Offer is for the specified number of group Reformer classes valid for the specified number of days from the date of the first class booked. Available to new clients only.

  • Clients found to be using multiple accounts to purchase our intro offers more than once will be charged at the price of a single casual class for all classes attended after the initial intro offer used. Additional penalties may apply.

STUDIO DEALS AND SPECIAL OFFERS

  • Studio deals and special offers cannot be shared, suspended/extended or refunded for any reason.

  • The terms and conditions listed with any studio deals and special offers apply.

PRIVATE SESSIONS

  • Private session single passes (Solo, Duo and Trio) are valid for 2 months from date of purchase.

  • The '5x Solo/Duo/Trio' pass is valid for 2 months from the date of the first class booked.

  • Extensions on these are only available upon sudden illness or injury, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Session packs are non-transferable and non-refundable.

  • Any non-cancellations, no show or absence will result in forfeiting that visit. If you do not attend a booked session or cancel within 12 hours of the class start time, you will be charged for the class.

  • SISU has the right to terminate a pass without notice for any unsatisfactory behaviour or other reasons decided by us, which occurs on our premises, in writing, or is directed at our staff or other members.

MEMBERSHIPS​

  • The Obligation Agreement Term is at minimum 12 weeks: An Obligation Agreement means an agreement that has a specific term commitment to maintain payments which in this case the term is 12 weeks (unless otherwise stated)

  • Fortnightly payment will be taken in advance at the start of each fortnight,  A dishonour fee may be charged if there are insufficient funds (we cannot provide a refund as this charge is made by our online payment provider Stripe).

  • The client must pay all fees and charges including GST as applicable, for the term of their membership. If payment is not successful, payment will be tried again 24 hours later twice at which time the Membership will be paused, booked classes cancelled you will be unable to attend or book classes until your payment is successful. 

  • Late cancellations (less than 12 hours), and non-attendance to any booked session will result in a lost session/additional charge if all sessions are allocated.

  • It is the responsibility of the client to book their classes in advance. Refunds or make up classes will not be given if a client fails to book ahead and classes are booked out

  • Because payments are fortnightly, clients have 2 weeks once the payment comes out to use spread the number of classes over the fortnight starting the day of payment. There is a 14 day rollover period for any credits which have not been used in the initial fortnightly cycle; these can not be used ahead of time.

  • SISU may adjust membership fees at any time giving 21 days’ notice.

  • Clients are entitled to apply to put their membership on hold for a maximum of 2 weeks over a 3 month period. A client may apply to pause their membership, giving 7 days notice via email due to medical, travel or personal reasons. Clients will not have access to any bookings or facilities that form part of the Agreement while the pause is in place. Longer periods will incur an admin fee of $10/week paid as an upfront payment before the Membership is paused. 

  • Signing up to a Membership is a legal commitment. Cancellations of the Membership prior to the Obligation Agreement term will ONLY be considered if there is serious illness or injury (a medical certificate must be supplied).

  • ​If you wish to cancel your membership after your minimum term, we require this form to be filled out. Membership cancellations will occur within 5 days of this  form being complete.

  • If any balance is outstanding for more than 4 weeks SISU may notify any credit reporting or referencing agency of the default, and may pass the customer’s debt for collection to a third party agency.

  • Memberships and perks for Membership clients are strictly non-transferable to other clients.

WAITLIST

  • Our waitlist system operates as a 'First in, first served' approach and works as follows: When a spot in the class becomes available, the system will automatically book the first person on the waitlist into the class. Customers can see where they are on the waitlist on their end. Each customer will receive a SMS confirming that they have been booked from the waitlist into the class. No customers will automatically be booked off the waitlist after the waitlist cut-off, which is 60 minutes before the start time of the class.

  • Adding yourself to the waitlist means that you are essentially committing to the class - please remove yourself from the waitlist if you can no longer attend. If you get get added to the class within the late cancel period of 12 hours and you cancel, you will be charged a late cancellation fee.

  • If you don't have enough credit on your account to attend a class, your card will automatically be charged for the class

PRIVACY POLICY

We are committed to ensuring that your information is secure. In order to prevent loss, misuse, unauthorised access, modification, disclosure, alteration, or destruction we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. In particular, e-mails sent to or from our website/email address/booking system may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail. We may collect the following information:

Name
Contact information including e-mail address
Date of birth
Emergency contact person
Payment history
Demographic information such as postcode
Other information relevant to customer surveys and/or offers
Sensitive information

Please note that we use a third party payment system (Stripe) which stores your credit card information.
